Services and Fees

Bespoke Legal Services

At Progressive Barristers, our focus is on bespoke or customized legal services that are responsive to your needs and budgetary constraints. This means having a flexible service model that includes:

  • Full Representation: This is the traditional model of “teeth to tail” services where we bring our experience and expertise to bear on all aspects of your case. For certain cases or tasks within a case, there is room to make this option more affordable through the use of ‘block fees’ and ‘contingency fees’. However, depending on the complexity of the case, we recognize that full representation may not always be within everyone’s financial reach.

  • Unbundled Services: We offer discrete services within the life-cycle of a litigation file while leaving other, less complex aspects for self-representation by the client. This may include assisting with drafting pleadings or motions, writing persuasive factums, or editing submissions. It may also include courtroom representation on complex motions or other critical attendances, while allowing clients the freedom to self-represent on more straight-forward or fact-driven aspects of their case.

  • Coaching for Self-Represented Litigants: Even if it is not feasible or cost-effective for a client to retain us, we can still provide valuable insight and guidance concerning the litigation process, the facts of the case, and the legal principles involved. With our experience and expertise, we have a good grasp of what will persuade judges and decision-makers. We work with our clients to devise strategy, to help them make informed choices about their case, and to represent themselves at a hearing with confidence.

Flexible Fee Options

Please contact us to discuss the specific rates that may apply in your case, and for fee options that may work best for you and your case.

  • Free / Deferred Fee Consultation: To work out the best service and fee options for you, we can provide a free or deferred fee consultation. We will provide an initial assessment of your case without charging any fees upfront. A consultation fee will only become payable if we become retained to provide further services in your case.

  • Hourly Rate: We offer fair and competitive regular hourly rates for our services.

  • Sliding Scale: To better facilitate access to our services, we take on a select number of files on a sliding scale.

  • Block Fees/Flat Rate: Having over two decades of collective experience means that we can estimate how much time it will take to complete a step in the legal process or to resolve an issue. Depending on your legal matter, we may be able to offer you a block fee or flat rate.

  • Contingency Fees: We accept certain employment law and human rights law cases on a contingency basis. This means we will not charge any fees up front, and will instead collect an agreed percentage of any final monetary settlement or judgement. The exact percentage will depend on the complexity and risks of the case and the stage at which the case is resolved. Our contingency rate typically starts at 20% and our maximum contingency fee is 33.33%. Lower fees may apply in your particular circumstances. Please feel free to contact us to obtain a quote for the percentage that applies to your case. For more information on contingency fees, you may wish to consult the Law Society’s guide, Contingency fees: What you need to know.

  • Legal Aid: We will accept Legal Aid Certificates in the areas of family law, landlord & tenant law, civil litigation and test case litigation.

  • Pro Bono: For cases that involve important issues of public interest, we may offer pro bono or “low bono” (i.e., very reduced rate) services. The provision of such services is an important part of our commitment to advancing access to justice.
